In Q3 of 2008 Midway reported a loss of $75.9 million USD, more than twice of the reported loss in 2007. They explained via a press release that despite this, they have high hopes for upcoming video games Mortal Kombat vs. DC Universe and Blitz the League II, though critics have noted the lack of anticipated software for 2009, which could potentially result in even more losses.

On February 12, 2009, Midway and its U.S. subsidiaries filed for bankruptcy protection under Chapter 11 of the U.S. Bankruptcy Code.
Most of its assets including Midway's Chicago and Seattle studios and rights to the Mortal Kombat and Wheelman series Were sold to Warner Bros. Interactive Entertainment on July 1, 2009.
Midway Games sold its San Diego studio to THQ on August 19, 2009.
Most of Midway Games Remaining assets were sold to Spiess Media Holding UG, F+F Publishing GmbH and SouthPeak Games.
